Terms/Conditions

  1. The first practice is a trial to see if it is a good match on both sides. Waitlist to enrollment is not FIFO. If lane X has room, pace X wait-listers will be enrolled first.

  2. Participants must be willing to circle swim.

  3. No drop-in policy. The only way to participate is to pay the up front fee and then come as often as you want. We do not offer an option under which you would pay per practice attended. The only exception is one member who is a seasonal resident (their primary residence is more than 50 miles away). Everyone pays an upfront fee. After that, there are no substitutions or refunds.

  4. We are operating this as a nonprofit 501(c)(3) and aiming to eventually be break-even and self-sustaining. Contributions are welcome, and we can provide you with our nonprofit info.

  5. We do not allow members of the public to drop in on a practice, but you can certainly bring a friend to practice. They just have to be over 18 and sign this form.

  6. We reserve the right to terminate anyone’s membership. It is essential that swimmers be kind and courteous to other swimmers.

  7. We lease pools and are otherwise unaffiliated with the owners.

  8. We are unaffiliated with U.S. Masters Swimming (USMS). We don’t participate in any of their programs or events. You can join them and participate in their events. It will not affect your status with us in any way.

  9. We will periodically update these terms and conditions without notice.

    Waiver

RELEASE OF LIABILITY -- READ AND AGREE BEFORE REGISTERING

 In consideration of being allowed to participate in any way in the soco swimming program, its related events and activities, I, the registrant, acknowledge, appreciate, and agree that:

 1.      The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

 2.      I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for participation; and,

 3.      I willingly agree to comply with the stated and customary terms and conditions for participation.  If, however, I observe any unusual significant hazard during my presence or participation, I will cease participation and bring such to the attention of the Company immediately;  and,

 4.      I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY  RELEASE, INDEMNIFY, AND HOLD HARMLESS  South Coast Swim LLC,

their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY REGISTERING AND HENCE AGREEING TO THIS RELEASE, I AM SIGNING THIS RELEASE AS OF THE DATE OF REGISTRATION AND DOING SO FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
